[WT논평] There’s a time and place for responsibility and maturity

Respect for the nation’s institutions is ever more grudging and scarce. Nobody likes Congress. The liberals and the left don’t like soldiers and policemen. The right is contemptuous of the academics and mainstream media that long ago lost connection to the mainstream. Everyone is suspicious of the criminal justice system and almost nobody is satisfied with how elections are run. Even the president of the United States “don’t get no respect.”

Americans have always been world-class grumblers. It’s what we pay for the liberty and freedom to speak up, loud and long. That’s what makes America special. That includes the freedom to overdo it, too. The courts, and especially the U.S. Supreme Court, have always stood above the smoke and noise, and in spite of controversy and anger the courts have generally been honored and respected as the fair arbiters of disputes.

But now, not so much. The consequences of this example of hyper partisanship is that the authority of the judicial system is under withering fire from the sidelines, with U.S. senators and the president attacking not just the judicial system, but judges themselves.

Characterizing someone who holds a contrary opinion as someone not just wrong, but evil, is un-American and undermines public faith in the institutions that make the nation tick. Mr. Trump has shown disrespect for both the judiciary system and the men and women who serve. Some are Democrats and some are Republicans. Some are liberals and some are conservatives. They differ in the way they interpret the law, but the Constitution gives them their independence for a good and sufficient reason. That reason must be respected by presidents, members of Congress, and even the professoriat and the press.

Everyone should chill and let the system work.

국민의 존경을 잃은 미국의 국가제도

국가제도에 대한 국민의 존중이 점점 미온적으로 변하는 가운데 드물어지고 있다. 의회를 좋아하는 사람은 없다. 진보주의자들과 좌파는 병사들과 경찰관들을 좋아하지 않는다. 오래전에 주류시민들과의 연계를 잃은 학자들과 주류언론을 우파는 경멸한다. 모든 사람들이 형사사법제도를 의심하고 있으며 선거 운영 방식에 만족하는 사람은 거의 없다. 심지어 미국 대통령조차도 “존경 받지 못한다.”

미국인들은 언제나 세계 정상급 불평가들이었다. 그것은 우리가 큰소리로 거리낌없이 길게 발언을 하는 자유의 대가로 지불하는 것이다. 그것이 미국을 특별하게 만든다. 그 속에는 지나치게 행동하는 자유도 포함된다. 각급 법원 특히 미국 대법원은 항상 연기와 소음을 초월했고 논란과 분노에도 불구하고 법원은 분쟁의 공정한 중재자로 존중과 존경을 받는 것이 일반적이었다.

그러나 오늘날은 별로 그렇지 못하다. 지나친 당파의식의 이러한 사례로 인한 각종 결과는, 미국 상원의원들과 대통령이 사법체제뿐만 아니라 판사들까지 공격하는 가운데 사법체제의 권위가 방관자들로부터 통렬한 비판을 받게 된 것이다.

반대의 견해를 가진 사람을 단지 나쁜 사람이 아니라 사악한 인간으로 묘사하는 것은 비미국적인 행동이며 국가를 가동시키는 여러 제도에 대한 국민의 믿음을 해친다. 트럼프는 사법체제 및 남녀 종사자들 양측에 대한 존경을 표시하지 않는다. 일부는 민주당원들이고 일부는 공화당원들이다. 일부는 진보주의자들이고 일부는 보수주의자들이다. 그들은 법을 해석하는 방식이 다르지만 헌법이 그들의 독립을 보장하는 데는 타당하고 충분한 이유가 있다. 그 이유를 미국 대통령과 미 의회 의원들 및 심지어 대학교수들과 언론도 존중해야 한다.

모든 사람이 냉정을 유지하여 체제가 작동하도록 해야 한다.
